NomNom Map - Terms of Use

Please read these Terms of Use ("Terms") carefully before using NomNom Map ("the App").

By downloading, installing, or using NomNom Map, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use NomNom Map. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account and Sign In

NomNom Map requires an account to use core features such as check-ins, the leaderboard, and badge tracking. You create your account using Sign in with Apple.

• You are responsible for maintaining the security of your Apple ID.
• You are responsible for all activity that occurs under your account.
• You must not share your account or allow others to access it.
• If you believe your account has been compromised, contact Apple and notify us promptly at info@lakesnowtech.com.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use NomNom Map only for its intended purpose — discovering and logging visits to NomNom-starred restaurants. You must not:

• Fake check-ins: Submit check-ins for restaurants you have not genuinely visited, or use technical means to spoof GPS coordinates to falsely verify attendance.
• Manipulate the leaderboard: Use multiple accounts, bots, scripts, or any other method to artificially inflate your check-in count or leaderboard rank.
• Abuse the platform: Attempt to reverse-engineer, decompile, or exploit any part of the App or its backend API.
• Upload harmful content: Attach photos or notes that contain illegal, offensive, defamatory, or infringing material to your check-ins.
• Interfere with the service: Launch denial-of-service attacks, scrape our restaurant database, or otherwise disrupt the App's operation for other users.
• Violate applicable laws: Use the App in any way that violates local, national, or international law.

Violations may result in immediate account suspension and permanent ban, without refund of any Premium subscription fees.

4. User-Generated Content

NomNom Map allows you to add personal notes and photos to your check-ins ("User Content"). By submitting User Content, you:

• Confirm you have the right to submit that content.
• Grant us a limited, non-exclusive licence to store and display your User Content solely to operate the App and its features (e.g. your check-in history within your own account). We do not display your private notes or photos to other users.
• Retain ownership of your User Content.

We reserve the right to remove User Content that violates these Terms or applicable law.

5. Premium Subscription

5.1 What Premium includes

Premium unlocks unlimited check-ins, custom restaurant entries, share cards, full visit history, and all current and future badge types. Free accounts are limited to 5 check-ins.

5.2 Subscription options

NomNom Map offers two Premium options, both purchased through the Apple App Store:

• Yearly subscription: Automatically renews each year at the then-current price unless cancelled at least 24 hours before the renewal date.
• Lifetime purchase: A one-time payment granting permanent Premium access for the current Apple ID on eligible devices.

5.3 Billing and renewal

All billing is handled by Apple. Your payment method is charged through your Apple ID account. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.

You can manage or cancel your subscription at any time through: iOS Settings → Apple ID → Subscriptions.

5.4 Free trial

If a free trial is offered, it will be specified at the time of purchase in the App Store. Unused portions of a free trial are forfeited upon purchasing a subscription.

5.5 Refunds

All purchases are processed by Apple. Refund requests must be submitted directly to Apple through the App Store. We do not control Apple's refund decisions. Apple's refund policy applies.

5.6 Price changes

We reserve the right to change the price of Premium subscriptions. If the price increases, we will notify you in advance via the App Store. Continued use of the subscription after the price change date constitutes acceptance of the new price.

6. Restaurant Data

The restaurant database in NomNom Map is sourced from publicly available internet data and data we collect ourselves. NomNom Map is an independent third-party application.

While we strive to keep restaurant information accurate and up to date, we cannot guarantee the accuracy, completeness, or timeliness of any restaurant data. Restaurant details (star ratings, addresses, operating status) may change without notice.

7. Intellectual Property

The NomNom Map app, including its design, code, graphics, icons, and all content we create, is owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or sublicense any part of the App or its content without our prior written permission.

8. Disclaimer of Warranties

NomNom Map is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

If the services or information we provide infringe upon your rights, please contact us immediately and we will handle the matter as soon as possible.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure at all times
• Restaurant information in the database is always accurate or current
• Any defects will be corrected

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of NomNom Map, including but not limited to loss of data, loss of revenue, or personal injury arising from reliance on restaurant information in the App.

Our total liability to you for any claim arising from or related to these Terms or the App shall not exceed the amount you paid for Premium (if any) in the twelve months preceding the claim.

10. Termination

You may stop using NomNom Map at any time and delete your account as described in the Privacy Policy.

We reserve the right to suspend or terminate your access to the App at our discretion if you violate these Terms. Upon termination, your right to use the App ceases immediately. Sections 7, 8, 9, and 11 of these Terms survive termination.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the People's Republic of China. Any disputes arising from or in connection with these Terms shall be submitted to the courts of competent jurisdiction in Hangzhou, Zhejiang Province, China.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last Updated" date. For material changes, we will endeavour to notify you through an in-app notice.

Continued use of NomNom Map after any changes to these Terms constitutes your acceptance of the revised Terms.
